I was operated for open heart surgery. The surgeon from USA brought a titanium plate to be fixed on the sternum (chest bones). Due to the fault in the titanium plate I had gone through tough time and survival was unpredictable. The doctors opened my chest 4 times due to the problem of the titanium. But the doctors did not know that titanium plate was the cause until they opened the fourth time. I had to spend 3 times more than usual charges and also I am not feeling well, too.Can I sue the company ?

- You can sue them. But, think for a while, if they couldn't have operated you......
- See a lawyer, but most important thing is to correct the problem first. No ammount of money is worth the discomfort so take the help of the lawyer to get this corrected so you feel right.

- Can you sue? This is America, man. You can sue anybody for anything. The major problem you might have is getting a lawyer to take the case. Lawyers take a huge chunk out of liability settlements, but their up-front costs, especially in a suit against a manufacturer, are high, and they won't take the case unless they think they are going to pocket some cash out of the deal. How do you know for sure the titanium plate was the "problem" ? What exactly was the defect in the plate? I have seen a lot of heart surgery in the past, and never saw anybody who needed a titanium plate to put their sternum back together. Why was it used? There are a huge number of questions that need to be addressed to determine whether you have a case or not. Even if you don't have a case, if your lawyer can gather enough morons for a jury trial, they might decide to give you money just because they feel sorry for you, even if the company was not at fault. America! What a country, huh?
- titanium is used as an implant all over the world, and usually does not give problems. there may have been an infection which did not resolve till the plate was removed. (the plate acts as a foreign body in the presence of infection.) unless you can prove negligence, or defect in the manufacture of the plate, you are not likely to win the case.

- I do not know where you are from. If you are in India, contact consumer guidance society of India. Under the RTI act, you can ask for the details of the entire treatment done in the hospital and with the details you can sue them for damage done and necessary componsation. Tell them onthier face that you will be going to consumer court. The will be too happy to settle it out of the court. Also tell them that you will be approaching the presswith the details.
